No. Proposition 126 opens the door for third-party alcohol beverage delivery using subcontract vendors (groups like DoorDash, Instacart, and UberEats). However, there is nothing written into the measure that ensures safety protocols are adhered to.
The giant tech companies pushing this measure are looking to grow revenues at any cost while refusing to take on the compliance and safety liabilities that go along with responsible alcohol delivery.
Currently, any alcohol delivery made in Colorado is attached to a license-holder for retail liquor sales—meaning if that alcohol beverage is delivered to a minor or intoxicated person, the store is responsible and can have its license suspended.
If Proposition 126 passes, neither the store that sold the alcohol, nor the tech company (Door Dash, UberEats, etc.) that arranged the sale and delivery will have any liability. This would result in a huge increase in access to alcohol by teens.
